39147 Closing letter

Dear Piya,

Given the time which has elapsed on this matter, should there be some official determination by the PAC regarding a non-responsive Public Body? Having reviewed the emails, it shows the Public Body was instructed to contact your office, but appears to have ignored that request.

I need some final resolution from the PAC as my next recourse is litigation.

I look forward to your response.

Thank you,

Mark McCoy

Hello, Mary Jo.
I sent an email yesterday addressing this very request and outlining in detail a number of points which constitute an appeal

Is this recent reply from the PAC in response to my email of 1/19/16, or from the earlier response from Mr. Murley?

For your reference, the substantive portion of my email of 1/19/16 follows:

This letter is in response to Mr. Murley’s reply below relating to 2 requests made to the St. Clair County Sheriff’s Department. I have never received a reply from the FOIA Officer for that public body, the St.

I submitted a similar request to the St. Clair County State’s Attorney, which was satisfied. However, different public bodies do not necessarily possess the same records, which is why a request was made to each for copies of records in their respective possession.

Mr. Murley, the FOIA officer for the St. Clair County State’s Attorney’s Office, replied (see below) to what I believe to be my request to the St. Clair County Sheriff’s Department.

To-date, I have not received a reply from the St. Clair County Sheriff’s Department. I do not believe Mr. Murley is the FOIA Officer for the St.
Clair County Sheriff’s Department, since I was directed by Major Thomas Knapp to send requests to his attention. Any response by Mr. Murley with respect to the requests outlined below are essentially unresponsive since the party responsible for the request is Major Thomas Knapp.

Furthermore, Mr. Murley states that certain records are exempt for disclosure as part of a pending prosecution, but does not cite the specific provision of the Act specifying which privacy exception is being invoked. It is also my understanding that subsequent to my initial request and Mr. Murley’s response, this case has been settled by way of a plea negotiation and order of the Court, thereby rendering any invocation of privacy pursuant to pending prosecution/investigation, moot.

Case 15OV0001966 is listed as closed on the Circuit Clerk’s website Case 14OV0004256 is listed as closed on the Circuit Clerk’s website Case 15OV0004474 is listed as Defendant having been sentenced and pending financial time payments on the Circuit Clerk’s website, which would indicate the conclusion of any investigation and/or prosecution.

For sake of clarity, I would like this request for review to be revisited by the PAC for a determination on the issues raised above, and to receive a reply, either complying with, or denying, the request made to the St. Clair County Sheriff’s Department.
